Terms of Service

These Terms of Service ("Terms") govern your access to and use of the wogd.ai website, the access-request and clearance systems, the member deck, and related services (collectively, the "Service"), operated by World of Game Design ("WOGD," "we," "us," or "our"). By requesting access, redeeming an access key, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years of age to request access or use interactive features of the Service. The Service is not directed to children under 13, and we do not knowingly collect personal information from them. If we learn that we have collected personal information from a child under 13, we will delete that information and revoke the associated access.
If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
2. Invitations, Access Keys, and Sign-In
The Service is invite-only. Access keys and clearances are personal to you, non-transferable, and may be revoked at any time. You are responsible for maintaining the confidentiality of your access key and sign-in credentials and for all activity that occurs under your clearance. You agree to provide accurate information when requesting access and to notify us promptly of any unauthorized use.
Some sign-in paths are provided through third-party identity services (including Atlas, operated by WOGD). Your use of those services may be subject to their own terms and privacy practices.
3. Acceptable Use
You agree not to use the Service to: violate any law or the rights of others; harass, threaten, defame, or abuse any person; impersonate any person or misrepresent your affiliation; upload malware or attempt to disrupt, probe, or gain unauthorized access to the Service or its systems; scrape, harvest, or bulk-export content except as expressly permitted; share, sell, or transfer an access key; or circumvent any access, security, or entitlement control.
4. Materials Behind the Airlock
Content available inside the member deck — including manifests, dossiers, demonstrations, pipeline details, and works in progress — is provided for your personal evaluation. You may not redistribute, republish, or publicly disclose that content without our prior written permission. We may mark specific materials as shareable; only those materials may be shared, and only as marked.
5. Your Submissions
You retain ownership of the information and material you submit through the Service, including access requests and descriptions of your projects ("Your Submissions"). You represent that you have the rights necessary to submit them. By submitting, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and use Your Submissions for the purpose of evaluating your request and operating the Service. We will not publish Your Submissions without your permission.
6. Intellectual Property
The Service, including the World of Game Design name, logos, artwork, video, text, and software, is owned by WOGD and its licensors and is protected by intellectual-property laws. Except for Your Submissions, nothing in these Terms grants you any right, title, or interest in the Service.
7. Third-Party Services
The Service integrates third-party services, including identity, hosting, and communication providers. Your use of those services may be subject to their own terms and privacy practices. We are not responsible for third-party services and do not endorse them by integrating them.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content will be accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
9. Limitation of Liability
To the maximum extent permitted by law, WOGD will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or fifty U.S. dollars. Some jurisdictions do not allow these limitations, so they may not fully apply to you.
10. Indemnification
You agree to indemnify and hold harmless WOGD and its officers, employees, and partners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Submissions, your use of the Service, or your violation of these Terms or the rights of any third party.
11. Suspension and Termination
We may suspend or revoke your clearance and terminate your access to the Service, in whole or in part, if you violate these Terms, create risk or legal exposure for us, or if we discontinue the Service. Where practical and lawful, we will provide notice. Upon termination, your right to use the Service ceases; provisions that by their nature should survive (including licenses you have granted, intellectual-property terms, confidentiality of deck materials, disclaimers, limitations of liability, and indemnification) will survive.
12. Changes to the Service and to These Terms
We may modify or discontinue features of the Service at any time. We may also update these Terms; when we make material changes, we will update the "last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules, except where your local consumer-protection laws require otherwise. The parties will attempt to resolve disputes informally first; any dispute not resolved informally will be handled by the state or federal courts located in Texas, and you consent to their jurisdiction, unless applicable law grants you the right to bring the matter elsewhere.
